EPA Finalizes New Unit MATS Rule; Mercury Limit in ICAC Petition for Reconsideration Adopted – On March 28, EPA Acting Administrator, Bob Perciasepe, signed a final rule announcing action on its reconsideration of certain issues in the final Mercury and Air Toxics (MATS) rule. In particular, EPA finalized the revised numerical emission limitation for mercury as recommended by ICAC in its April 16, 2012 petition for reconsideration. The ICAC petition recommended raising the mercury emission limitation from 2.0E-4 lb/GWh to 3.0E-3 lb/GWh for coal-fired power plants that are not designed to burn low-rank virgin coal based on measurement and operational concerns.
EPA did not finalize requirements to control emissions of particulate matter and toxic pollutants during periods where power plants are starting up or shutting down. EPA said it is still reviewing comments on those provisions and will address them in a separate action. The mercury and air toxics rule will take effect as soon as it is published in the Federal Register.
